Judge Carter rules in favor of Patrik Griego in the lawsuit filed against the County for their hiring of Public Defender Marcus




 

"We are extremely pleased with the court's decision today overruling the County's demurrer," said Mr. Patrik Griego. "We are hopeful that at the next hearing the court orders the Board to terminate Mr. Marcus's employment and orders the Board of Supervisors to appoint a qualified attorney to run the office."
Visiting Judge Marjorie Carter ruled in favor of local attorney Patrik Griego on behalf of John Does et al vs Humboldt County regarding the hiring of David Marcus as Public Defender.

The case can now move forward and the County has a deadline to file a response to Mr. Griego's new lawsuit.

A previous lawsuit had been dismissed in June with the Judge Carter giving Mr. Griego thirty days to file a new amended peition. After a deposition of Mr. Marcus, Mr. Griego filed this  new complaint.

I contacted County Counsel and a couple of Supervisors for comment. No response, yet.
