Public Defender a no show for court, possible Marsden hearing ?

Trial assignment in Courtroom 5 started at 9:45 a.m. Public Defender David Marcus was a no show, cases were passed. Deputy Public Defenders talked to clients, called him. One client Miles Eastman wanted to address court.

Mr. Marcus eventually showed at 10:35 a.m.

Heard there maybe a Marsden hearing against him.

10:45 a.m. Just confirmed in court. Marsden hearing will be in Courtroom 2. Visting Judge Bob McNatt.


First both went in; then Miles Eastman spoke with the Judge alone, then Mr. Marcus went in.

The Marsden motion was denied.




Client is Miles Eastman. Case filed July 26, 2016. Misdemeanor DUI. Count 1 Driving under Influence; Count 2 Driving Under Influence of Alcohol. The defense had filed a motion to continue; no opposition by the People. Judge Christopher Wilson granted the motion to continue.

Deputy District Attorney Brie Bennett was present for most cases for trial assignment, including this one.


Lost Coast Outpost's Rhonda Parker and I were already in Courtroom 5 for other cases. Thad Greenson from NCJ showed up at 10:40 a.m.
