Marci Kitchen preliminary tentatively continued to March 20; 11 witnesses for DA, 5 day estimate

Judge Joyce Hinrichs found good cause and granted the continuance requested by the defense, again.

Deputy District Attorney Roger Rees subbed in for DDA Stacey Eads who is prosecuting the case. He said the People opposed the continuance and had complied with Marcy's law.

Mr. Benjamin Okin, one of Kitchen's attorneys, appeared on her behalf and on behalf of her other attorney, Mr. Patrik Griego.

Mr. Okin told Judge Hinrichs that the defense had received a lot of discovery and needed to process it send out for lab work.

Intervention is March 16 at 9:45 and the preliminary is March 20 at 9:45. If that needs to change, defense will notify the court since one trial court is being set aside for the entire week of March 20 for this case.

 People intend to present 11 witnesses and an estimate of five days was given by both parties.

A hearing is scheduled on November 30 to see if the motion will be granted at 10:15 a.m.

Charles Cole second jury trial on alleged charges of animal cruelty confirmed for December 12




Trial confirmation was scheduled this morning for Charles Cole's second jury trial.
Dates confirmed.


His conditional plea had been rejected in October and his jury is scheduled for December 12.

HCSO is not seeking charges against Anthony Lux but is investigating claims he made about why he took his daughter



The Humboldt County Sheriff's office will not seek charges against Anthony Lux,  Undersheriff William Honsal told me. Undersheriff Honsal said that the case is not being referred to the DA's office and that Lux is fully cooperating with law enforcement.

He said when Lux was interviewed, he told HCSO that Child Welfare Services provided him with inaccurate information which led to him taking his daughter away from her grandmother.

HCSO is investigating the case and the alleged misinformation claim.

EPD sees increase in residential burglaries in November, mostly in Henderson Center area

Yesterday a lady approached my patrol vehicle, while I was parked at College of the Redwoods, and handed me something. She stated it was for me, I thanked her and she hopped back into her vehicle and drove off. I opened it and it was a gift card for coffee. That is not what got my attention, it was the message she had written in it.

Eureka citizen files complaint with DA, state attorney general and FPPC on possible violation of election code


On November 28, a complaint was sent by a Eureka citizen to the state attorney general via electronic e-mail. Also a complaint sent to District Attorney Maggie Fleming
via electronic e mail. A complaint to FPPC  via certified registered mail was sent today.

Update 11/30:

DA Maggie Fleming responded to Robert Tuel and asked him to file a complaint with the Secretary of State since they investigate election fraud.


Eureka City Finance Department follows up; Austin Allison does need to get a business license




Eureka City Manager Greg Sparks notified me via email this morning that Austin Allison said he will be in to get a business license.

"The finance department contacted Mr. Allison and reviewed his business activities with him.  It was determined that even though he does not sell products from his home that he is required to have a license.  He indicated that he will be in within the week to obtain a license.'

Benjamin Heidmann and Konnor Wright were supposed to have their jury trial set tomorrow at 8:30 a.m.

The Public Defender's office, who represents Heidmann has filed, again, for a continuance. That motion will be heard tomorrow morning.

Alleged child abduction suspect Anthony Lux sought by law enforcement





On Sunday, November 27, 2016 at about 7 p.m. Humboldt County Deputy Sheriffs responded to the 4100 block of Hillside Ct. in Eureka for a reported child abduction by parent.  The reporting party told deputies when she was in another part of her residence, Anthony Lux (31) unexpectedly left with his daughter, 4 year old Allison Shirey.  The reporting party provided court documentation stating she has temporary physical and legal custody of Allison.   Lux did not have permission to take Allison from the residence. 
It was later discovered Lux received a ride from the residence on Hillside Ct. to St. Joseph’s Hospital.  Lux did not check into the hospital and has not been seen since.  Lux has connections in Alderpoint, Eureka, McKinleyville, Montegue (Siskyou County) and Chico (Butte County).  Lux’s whereabouts are unknown at this time. 

Homicide suspect now alleged victim in Mendocino weed related murder

During this investigation the Mendocino County Sheriff's Detective Unit was able to contact and interview Amanda Wiest,  a 26 year old female, from Fairfax Virginia, who had previously been listed as a possible suspect in this case. At the conclusion of that interview Wiests' status has been changed from suspect to victim of a kidnapping along with a four year old child.  Charges of kidnapping with be forwarded to the District Attorney's Office for review in addition to the charges of homicide and robbery against the suspects in this case.

On the evening of 11/23/2016 Gary "Giggles" Fitzgerald turned himself into the custody of the Mendocino County Sheriff's Office.  He was charged and booked into the Mendocino County Jail on a charge of homicide.  His bail was set at $650,000.

The investigation into this case is ongoing with the Sheriff's Office Detective Unit actively seeking to arrest the 5 additional suspects in this case.

EPD investigation into 17th and L incident reveals juvenile armed with a gun




Just spoke with Eureka Police Chief Andrew Mills.

In their ongoing investigation, "We now find out the suspect, a 16 year old juvenile, was armed with a gun. " Crime scene is being searched .

According to Operation Safe Streets, Eureka, a loaded revolver had allegedly been thrown from the roof.

EPD Crime Analyst Brittany Powell said, "The original call was for a residential burglary alarm.  Officers found the firearm inside of the residence."

Hiding in a dryer did not work out for this alleged burglary suspect

This was a suspect at the 17th and L incident.

EPD responds to a 911 call that was not completed; is no update a good sign?






According to a report on scanner traffic indicates , CHP received a 911 call somewhere near 4th and C around 7:40 p.m. A woman asking someone to leave. The call was not completed, dispatcher called back, no response ; EPD went to check.

Trying to get HCSO to confirm this tip: the dead man at Blue Lake Casino hotel this morning had a sheet around his neck. Also, it seems a woman may have been in the room.

KRCR/KAEF got the latest on the alleged stabbing in Hoopa, first. One million bail for alleged suspect.

On 11-25-16, at approximately 3:05 AM, the Humboldt County Sheriff's Office received a call regarding a disturbance at a residence on lower Cal Pac Rd in the Hoopa Valley. Deputies and Medical personnel arrived on scene and located a female victim in the residence with multiple wounds.  The victim succumbed to her injuries at the scene.
During the investigation, Lorence  Emmanuel Bailey  was identified as person of interest. Bailey was located and subsequently arrested for PC 187-Murder. Bailey was booked into the Humboldt County Correctional Facility and bail has been set at $1,000,000.

Minutes ago, Shasta County Sheriff spoke about the disappearance of Redding's Sherry Papini, now safe. In her case, it was 22 days.

The above issue hits home and this link somehow didn't make it in local media. The court case of David Anderson was not covered by the local media, all three trials were covered on this blog. TS covered it when a local victim approached them.

Hezekiah Allen said what is highlighted below is not indicative of "our culture" on another local online site. He must have been sleeping through the court case of Kailan Meserve, again not covered by other local media until sentencing and no one covered the Throckmorton case.


Undersheriff William Honsal was interviewed for the story below.

Honsal said he believes that’s the reason his county leads the state in missing person’s reports.
“We have people that call us every year and say, ‘my son or my daughter or my boyfriend or my friend went to Humboldt county to grow marijuana or to help process marijuana, trim marijuana, and we haven’t heard from them in six months… do you know what happened to them,’ and we don’t.”
Honsal said many of them are forced into slave labor, locked behind multiple gates in rugged, rural areas of the county. However, he noted sometimes victims do get away, and come forward.
“There have been cases where females have been drugged and raped and held against their will, and that… that has happened.”

Scott Joseph Crane still in custody, will be booked and released today




Just stopped by the Humboldt County jail. Scott Crane will be  booked and released today and given a future court date for the most recent arrest.

$1 million bail set for armed robbery suspect Christian Shepard




Did post earlier. His public defender waived bail/OR hearing without prejudice.

Preliminary on December 8 at 9:45.

One plea rejected, now just before the jury trial starts again, a change of plea entered by David Lockhart

After the last plea was rejected by Judge Timothy Cissna, and the case went all the way to a jury trial again, today during trial assignment, Lockhart's jury trial was vacated and a change of plea entered for 12/1/2016.

David Lockhart is charged with Count 1, vehicular manslaughter without gross negligence in the death of Hannah Denise Baker. There is a special allegation that Lockhart caused great bodily injury or death to John Doe.

Mr. Patrik Griego, who represents the Baker family, is discussing this possible option with the family. For background on the case and why the other plea was rejected, please see link below.

One Discovery Inn suspect to be arraigned today; another listed for January 5, 2017

Altonique Burton does not have arraignment scheduled until 1/5/17. David Watty is scheduled for arraignment today in Courtroom 4.

Burton is charged in the complaint filed by the DA for resisting an Officer; EPD officer Jenkins.

Watty is charged with Resisting/Obstructing/Delaying a Peace Officer or Emergency Technician; EPD Officers Jenkins, Bise, and Omey.


Armed robbery suspect Christian Shepard charged with 10 felonies and special allegations



Christian Shepard, the suspect in the string of armed robberies will be arraigned in Courtroom at 1:29 this afternoon.

He is charged with 10 felony counts and special allegations.

One attempted second degree robbery count, the rest are second degree robbery. These include the alleged armed robberies at Benbow Inn and Red Front Store and each location is different, includes Eureka, Arcata and Mckinleyville.

Law enforcement in Cutten looking, may be closer to finding lost 14 year old


Law enforcement presence in Cutten  tonight, including a helicopter, looking for a lost 14 year old are making progress.

Hopefully, will locate her soon.

She was located by the Rescue Team shortly after 10 p.m. after the Coast Guard helicopter located her.


Press Release (11/23):

On November 22, 2016 at about 4:18 p.m. the Humboldt County Sheriff’s Office received a telephone call from a 14 year old female reporting she was lost in the woods in the Ridgewood area.  The female was told to stay put and attempt to preserve her cell phone battery. Her cellular telephone was “pinged” which provided a detailed location.  Deputies responded to the area and were able to make voice contact with her, but could not physically locate her.  A PAGER 30 was initiated. A PAGER 30 is a process in which all Humboldt County Sheriff’s Posse Search and Rescue volunteers are notified that they are needed for a search and rescue in progress. The HCSO mobile command post was set up in the Berry Lane area and the US Coast Guard was contacted with a request for helicopter assistance.  Three search teams were deployed, two of which were HCSO/Posse members and one team of citizen volunteers.  The volunteer team was able to locate the female unharmed.  After about an hour it was learned that the volunteer search team and juvenile were stuck and unable to make it out of the woods.  The USCG helicopter had been on scene searching and left once the juvenile was located.  The helicopter returned by request, and at 2:14 a.m. hoisted all 3 people out of the woods.  They were then all flown to the Heli-pad located a St. Joseph Hospital.  The juvenile was treated at the hospital and later released to family. 
The Sheriff’s Office would like to thank the USCG and the citizen volunteers for their help.  It should be noted the Sheriff’s Posse Search and Rescue team is comprised completely of volunteers and operates entirely off donations at no expense to tax payers.     

Daniel Pratt Jr 's bail set at half a million for charges that include attempted murder

On Monday, November 21, 2016 at about 11:30 a.m. the Hoopa Valley Tribal Police Department received a report of shots fired at a vehicle on Bair Rd in Hoopa.  HVTPD Officers spoke with the male victim.  The male victim stated he was sitting in his vehicle when suspect Daniel Pratt, Jr. (18 years old) drove up to his vehicle in a white SUV, exited his vehicle with a firearm and fired several shots into the air.  Pratt brandished an additional handgun and demanded the victim hand over all of his stuff.  The victim began to drive away and Pratt fired shots into the victim’s vehicle.  No one was injured during this incident.


Now that there is an official complaint, will the City of Eureka still not look into Austin Allison?


An official complaint was filed today, see content below, and sent to Eureka City Manager Greg Sparks and Eureka City Finance Director, Wendy Howard.
An official complaint has been filed with the City of Eureka to look into whether Allison has a business license or not?


"It is my understanding that Austin Allison has a small furniture making business in Eureka. It is also my understanding that he does not have a business license. I want to make this an official complaint and have Austin Allison be required to obtain a business license for doing business within the city of Eureka. Thank You Robert L. Tuel"

I never heard back from the City of Eureka after my last inquiry. Still no word from the City of Eureka.

The City of Eureka is in a tough situation with three current Councilmembers backing Allison.

Guess the City of Eureka and the rest of the media don't think its relevant if a City Council candidate does not have a business license




After just pleading guilty to assault, Scott Crane is allegedly exposing himself to people across from Mckinleyville high school




Barely been a few days since he was released on misdemeanor probation after pleading guilty to two misdemeanor assaults, one being Max, the security guard at Mckinleyville Safeway.

Just got contacted that Scott Crane is  at the bus stop on Mckinleyville Avenue, across from the high school, allegedly exposing himself to people.

Two citizens stopped by to give a woman waiting at the bus stop a ride because she looked terrified.

Law enforcement got called, Scott Crane just arrested. He has not been booked as of 1:05 according to the jail.

HCSO PIO Selena Zorilla-Mendoza confirmed that, "Scott Joseph Crane was arrested at approximately noon today for violation of probation, public intoxication, and resisting arrest."

After allegedly violating a court order being remanded, Kirby Bay gets private attorney and asks for another bail hearing

 Kirby Bay has decided to retain private attorney David Crane. Previously Bay has been represented by Conflict Counsel's office.

There is a Bail/OR hearing on December 22.
**Update: Court entry in system was incorrect. I was notified later today that the OR/Bail hearing was today 11/22. Judge Joyce Hinrichs did not make a ruling today. She wanted to read the preliminary transcript and will issue a ruling tomorrow at 11 in Courtroom 5.**

People requested increase in bail. Judge Hinrichs was initially going to grant it but decided to read the transcript and think more on the decision.

Since there is now a new attorney,  defense requested a disposition and reset to Feb 8, 2017 to set a new date for jury trial in the newer case where there is allegation of violation of court order in Courtroom 1. There is also another date of February 21, 2017 for disposition and reset in that case.

In the older case, trial conformation is on February 8, 2017 and jury trial is scheduled for February 21, 2017

The alleged victim did not object to the rescheduling of the jury trial.

Update : 11/23. Supervised release. Has to wear ankle monitor. Stay away from alleged victim and minor child.



Dazey's burglary suspect Levi McDonald pleads guilty; agrees to drug treatment and probation



Levi McDonald plead guilty today with an offer of probation instead of additional jail time.

He had served 42 days in jail and got 42 days in good time credit for a total of 84 days jail time.

Upon release, which is today, McDonald is ordered to contact probation and participate in drug treatment.

McDonald also agreed to the $3,000 + amount of restitution requested by Dazey's.

After sentencing him, Judge Marilyn Miles wished him luck and urged him to deal with his drug issues that seem to be the root cause of his incarceration. McDonald thanked Judge Miles for this chance.

20 year old in 299 collision passed away from injuries

CHP Update:

The Humboldt Area office is saddened to inform you the young 20 year old; Ramiro Melecio had succumbed to his injuries sustained in the traffic collision.  Our thoughts and hearts go out to the family, friends and the community.

Defense motion to dismiss charge against Ewa Misztal denied ; jury trial continued





Trial confirmation and a ruling by Judge Joyce Hinrichs on the defense motion to dismiss the charge against Ewa Misztal was scheduled for this afternoon.

Defense motion to dismiss denied. Setting of new jury trial  scheduled for November 22.

David Laron Watty and Altonique Burton arrested yesterday at Discovery Inn

David Laron Watty and Altonique Burton arrested for incident yesterday at Discovery Inn.

EPD Crime Analyst Brittany Powell said, "The original call was for a physical fight in the rear parking lot involving two females and a male.  One of the females was described as the primary aggressor.  The male and one of the females were both arrested for corporal injury on a spouse or cohabitant and resisting arrest."

A google search revealed prior records for both suspects other places besides Humboldt .

Locally Burton and Watty have traffic/infraction cases; Watty plead guilty of assault in 2015 after preliminary hearing and was granted 3 years formal probation on 3/9/16 .

Two arrested at Discovery Inn on Broadway








EPD arrests one male and female at Discovery Inn. Six police cars on scene. According to an observer, it was an African American male and female. The African American female was allegedly stark naked in the middle of the street.

I just spoke with EPD's Captain Steve Watson who just left the scene. When EPD arrived at the location, there were two people involved in an altercation. The female was allegedly pepper spraying the male. Captain Watson confirmed what an eye witness told me.

The African American female had her shirt off and was challenging the officers and yelling at them not to do anything because she is black, then she pulled her pants down and her behavior was crazy and out of control.

Both are in custody.

I have the entire video, it is a large file. Since it has the actual arrest with the above observation and nudity, I cannot post it on blogger or facebook. An edited version is on my business facebook page. It is copyrighted, as is all material on my blog.

On Friday, November 18, 2016 at about 7:30 p.m. Humboldt County Sheriff Deputies responded to a residence on Upper Ranch Rd in Willow Creek for a report of a home invasion robbery. The reporting party told Deputies two unknown suspects entered the residence, brandished a firearm, demanded marijuana and money.

On Monday, Nov. 21, the Veterans Service Office (VSO) opened the doors at
its new location. The VSO has been located inside the Humboldt County
Courthouse since the 1940s.

ARREST MADE IN STRING OF HUMBOLDT COUNTY ARMED ROBBERIES.

The Eureka Police Department has been investigating a string of robberies which have been occurring at various businesses throughout the County of Humboldt. The robberies began late in the evening on November 3rd, 2016, with the most recent occurring on November 18th, 2016. In all of these robberies, the suspect’s general description, method of operation, and weapons used appeared to be similar.

Through the course of an extensive investigation, detectives of the Eureka Police Department developed a suspect and identified a possible involved vehicle. The suspect was identified as Christian James Shepard (26 Years old of Rio Dell). Shepard was discovered to be on probation out of Sacramento County and had an active warrant for his arrest out of Sacramento County for probation violation.

A countywide attempt to locate was issued for Shepard to all Humboldt County Law Enforcement agencies.

On November 19th, 2016, Rio Dell Police Officers observed Shepard and his vehicle. Officers attempted a traffic enforcement stop on him. Shepard fled and a vehicle pursuit ensued. Shepard led Officers onto Monument Road, but due to the high speeds and reckless driving of Shepard, officers discontinued the pursuit.

In the early morning hours of November 20th, 2016, it was determined that Shepard may have run off the road shortly after the pursuit was terminated, the prior evening, and had spent the night in the woods. Deputies of the Humboldt County Sheriff’s Office and officers of the Rio Dell Police Department responded to the area and located Shepard and his vehicle traveling on Monument Road, back towards Rio Dell. Shepard was taken into custody without further incident. Shepard was soon transported to Redwood Memorial Hospital, where he was treated and released for possible hypothermia.

Detectives of the Eureka Police Department responded and took over the investigation. Shepard’s vehicle was seized and towed from the scene. A later search of the vehicle was conducted, pursuant to a search warrant.

As a result of the search, clothing items, masks, and weapons consistent with those used in the string of robberies were seized as evidence.

Shepard was soon booked into the Humboldt County Correctional Facility on ten (10) counts of robbery, felon in possession of a firearm, negligent discharge of a weapon, terrorist threats, and for the Sacramento County probation warrant. Shepard does not qualify for bail due to the Sacramento County Arrest Warrant being a “no bail” warrant.

There are no photographs being released of Shepard at this time, due to investigative steps that still need to be completed.

The Eureka Police Department would like to thank all Humboldt County allied agencies, especially the Humboldt County Sheriff’s Department and the Rio Dell Police Department, for their assistance in this investigation. If not for their help, this dangerous criminal may not have been taken into custody.
