DA's office did locate the CHP report the on Kitchen case I requested but it is exempt from disclosure

Last night, I did this post saying a report on the Kitchen case had been forwarded to the DA by CHP. I requested a copy from both CHP and the DA's office. This link includes a response from CHP Officer Cy May from this morning.

This morning at 7:56 a.m. I received a response from CHP PIO Officer Cy May at 8 a.m. This is his email response:

"The report has not been completed nor has it been forwarded to the DA’s Office."


DA Maggie Fleming has been in meetings and busy all day but she got back to me with the response pictured below.

The DA's office did locate the report but cannot release it because it has been filed for pending litigation and is exempt from disclosure.
